Board of Water Commissioners

The meeting was called to order at 7:00 p.m. by Chairman Dale Donovan.  Commissioners in attendance included Ira Wood, Michael May and Helen Miranda Wilson.  Commissioner Jerry Houk was absent.  Town Administrator Tim Smith also attended.

The Board held the continuation of the public hearing to consider the Wellfleet Municipal Water System Rules and Regulations.  Donovan read the public notice.  He suggested that the Board finish work on the rules and regulations this evening, forward them to staff to make the appropriate changes and finalize them at a future meeting.

The Board considered the Wellfleet Board of Health Recommendation for Water System Connection Criteria as revised 10/13/04.  Donovan suggested that the Board consider replacing the Wellfleet Municipal Water System Policy Statement with the Board of Health document renumbered as necessary.
·       2.1.0 – Donovan suggested adding “Appendix A” after (ATBS) in the first sentence.  Wilson suggested adding “in the original ATBS in the vicinity of the Transfer Station.” after “undeveloped lots” in the second sentence.  On a motion by Wood, seconded by Wilson, the Board voted unanimously to eliminate paragraph 1. in the current “Policy Statement” and replace it with the Board of Health’s paragraph 2.1.0 with the language suggested by Donovan and Wilson.
·       2.1.1 Statement of purpose – on a motion by Wood, seconded by May, the Board voted unanimously to accept this paragraph as drafted.
·       2.1.2 Criteria for prioritization for water system connection – Wilson suggested adding language requiring that the Health Department take the mandated water samples.  Health/Conservation Agent Emily Beebe noted that the Health Department does not have the necessary staff.  On a motion by Wilson, seconded by Wood, the Board voted 3-1, with Donovan voting against, to accept this section as drafted.
·       2.1.2.1 Contamination – on a motion by Wilson, seconded by May, the Board voted unanimously to accept this section as drafted.
·       2.1.3 – Donovan moved and Wood seconded a motion to eliminate section 2.1.3.  Wood moved and Wilson seconded a motion to amend the motion by leaving the last sentence of section 2.1.3.  Donovan suggested that the words “Upon request by the Water Commissioners” be added at the beginning of the last sentence of this section.  After discussion, Wood rescinded his motion for amendment and Wilson rescinded her second.  On the original motion the Board voted 3-1, with Wilson voting against.  On a motion duly made and seconded, the Board voted unanimously to place the last sentence of 2.1.3, substituting “Health Department” for “Board of Health”, as the last sentence of 2.1.2.
·       2.1.4.1 Site Conditions – on a motion by Donovan, seconded by May, the Board voted 3-1, with Wilson voting against, to eliminate section 2.1.4, Site Conditions.

·       2.1.5 Application Procedures – on a motion by Donovan, seconded by May, the Board voted 3-1, with Wilson voting against, to eliminate section 2.1.5.
·       2.1.6 Applicability of Water Use Restrictions – Donovan moved and May seconded a motion to eliminate section 2.1.6.  Wilson moved and withdrew a motion to amend the motion by adding language requiring quarterly gallonage reports from the master meter.  The Board voted unanimously in favor of the original motion.  A motion by Wilson to add language to require that records of water usage be provided to the Board of Health, Health Department and Water Commissioners was not seconded.
·       Appendix 1 – Wilson suggested that the terms MCL and RCL be written out as “Maximum Contaminant Levels” and “Recommended Contaminant Level” parenthetically – it was noted that the terms are identified elsewhere in the document.
·       Wellfleet Municipal Water System Rules and Regulations, IV. General Operational Conditions, Section 4.8 – on a motion by Wilson, seconded by Donovan, the Board voted unanimously to insert “mixed use” after “condominium,”.
·       Connection Charge – Donovan moved and Wood seconded a motion to set the connection fee at $6,000.  Discussion included additional costs related to hooking up to the system.  On the motion, the Board voted 1-3, with Wood, Wilson and May voting against.  A motion by Wilson to set the connection fee at $9,500 was not seconded.  Wood moved and Wilson seconded a motion to set the connection fee at $9,000.  There was consensus that the Board wants more information and the Town  Administrator was asked to come back to the Board with relevant figures.
·       Wellfleet Municipal Water System Rules and Regulations, Background Information – on a motion duly made and seconded, the Board voted unanimously to set the capacity at 37,500 gallons when a new Coles Neck well goes on line.  A motion by Wilson to change the allocation for new residential connections from 155 gpd to 400 gpd was not seconded.

Wilson moved that her question regarding customer notification of an emergency shutoff be sent to Town Counsel along with the updated Rules and Regulations.  Donovan indicated that it will be forwarded.

On a motion by Wood, seconded by May, the Board voted unanimously to continue this hearing to Monday, November 15, 2004 at 7:00 p.m.

The Town Administrator recommended selling 650,000 gallons of water for the slurry wall to the contractor capping the landfill at a cost of $7,900.  On a motion by Donovan, seconded by May, the Board voted 3-1, with Wilson voting against, to sell to the construction company doing the landfill capping 650,000 gallons of water necessary for the project.

Wood moved and May seconded a motion to approve the minutes of October 5, 2004.  On a motion by Wilson, seconded by Donovan, the Board voted unanimously to amend the minutes by adding “and supply” to page 2, second to last sentence of the first paragraph.  The Board voted unanimously to approve the minutes as amended.

On a motion duly made and seconded the Board voted unanimously at 9:13 p.m. to adjourn the meeting of the Board of Water Commissioners.

Board of Selectmen

The meeting was called to order at  9:14 p.m. by Chairman Ira Wood.  Selectmen in attendance included Michael May, Dale Donovan and Helen Miranda Wilson.  Selectman Jerry Houk was absent.  Town Administrator Tim Smith also attended.

On a motion by Wood, seconded by Donovan, the Board voted unanimously at 9:15 p.m. on a roll call vote (Donovan, May, Wilson, Wood – yea) to enter executive session to discuss strategy with respect to collective bargaining and contract negotiations with non-union personnel and not to reconvene in open session.
